Privacy Policy

By this policy, FOCSIV Volontari nel Mondo (hereinafter also referred to as FOCSIV or Controller) informs you about its processing policies for personal data collected during the use of the services requested from time to time.

This policy is provided pursuant to art. 13 of EU Regulation 2016/679 – General Data Protection Regulation (hereinafter referred to as GDPR).

A) DATA CONTROLLER 

The Controller of the processing of your personal data is FOCSIV, registered office in Via San Francesco di Sales, 18 – 00165 Rome, 

B) DATA TREATMENT MANAGER

The Data Treatment Manager has been appointed by the Controller. FOCSIV uses some third parties that carry out on their behalf activities that also involve the processing of personal data controlled by FOCSIV.

Due to the characteristics of the project for which your data will be processed, these may be treated by the following partner organizations:

C) DATA SUBJECT TO THE PROCESSING

The Data Controller will process your personal data collected during registration. Both common data (such as, by way of non-exhaustive example, name, surname and email address), and data included under “special categories” pursuant to article 9.1 of the GDPR are subject to processing.

D) THIRD PARTY DATA VOLUNTARILY PROVIDED BY THE USER

In using certain services, third parties’ personal data that you have provided to FOCSIV may be processed. In this event, you are the independent data controller, assuming any legal obligation and responsibility. In this regard, you grant the widest indemnity with respect to any objection, claim, request for compensation for damages from processing, etc. that should reach the Data Controller from third parties whose personal data has been processed through your use of the services on the Website in violation of the relevant rules on the protection of personal data. In any case, if you provide or otherwise process third parties personal data, from then on you assume all connected liability and this hypothetical processing shall be based on the prior acquisition – on your part – of the consent of the third party to the processing of information concerning it. 

E) PURPOSE, LEGAL BASIS AND OPTIONAL NATURE OF THE PROCESSING

Your personal data will be processed, with your consent where necessary, for the following purposes where applicable:

  1. fulfilment of any obligations required by applicable laws;
  2. direct marketing via e-mail for services similar to those you have subscribed to;
  3. elaboration of studies, researches, market statistics; sending of informational and promotional material relating to activities, services and products by FOCSIV and its commercial Partners, or surveys to improve the service (customer satisfaction). Such communications may be made by e-mail or text message, by regular mail and/or through a call-centre and/or through the official FOCSIV pages/profiles on social networks;
  4. analysis of your interests and habits also with the aim of sending you customised information and promotional material about the services offered;
  5. dissemination of your image on the communication channels available to FOCSIV.
  6. consent to the registration on the FOCSIV website and access to restricted areas, including to the mobile application;

The processing of your personal data will be carried out using manual, computerized and telematic tools, however suitable to guarantee the security and confidentiality of the data.

The processing of your data for the purposes referred to in points 6 is legally based on the provisions of art. 6 (b) of the GDPR. “Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.”

The processing for the purposes referred to in point 1 is legally based on the provisions of art. 6 (c). “Processing is necessary for compliance with a legal obligation to which the controller is subject.”

The provision of your data for the aforementioned purposes is optional, however failure to provide data will make it impossible to receive the services requested.

The processing for the purposes set out in points 3, 4 and 5 is legally based on the provisions of art. 6 (a) “The data subject has given consent to the processing of his or her personal data for one or more specific purposes.” Also consent to processing for the purposes set out in points 3, 4 and 5 is optional and does not affect the use of the services. In the absence of your consent to the processing referred to in point 3, FOCSIV will not send you communications about its initiatives and offers. In the absence of your consent to the processing referred to in point 4, FOCSIV will not be able to send you customised communications and information, but only general communications: we therefore recommend you, if you wish to receive communications suitable to your interests, to give your consent. Finally, in the absence of consent to the processing referred to in point 5, FOCSIV will not disseminate your image on any communication channels.

In any case, it is specified that if you wish to oppose the processing of your data for marketing purposes carried out with one or more of the means indicated above in point 3, you may at any time do so by writing to the physical address of the holder (selective opt-out), as required by the current pro-tempore legislation. You have the right to revoke the consent given for the processing referred to in points 3, 4 and 5 at any time, without prejudice to the use of the services or the lawfulness of the processing carried out before your opposition.

Finally, your personal data belonging to “special categories” of data, will be processed, with your explicit consent, in accordance with the provisions of art. 9.2 (a) of the GDPR and the pro-tempore Authorisation in force by the Authority for the protection of personal data.

F) ADDRESSEES AND TRANSFER OF PERSONAL DATA

We can share you personal data with:

  1. Individuals, companies or professional firms that provide assistance and advice to FOCSIV on accounting, administration, legal, tax and financial matters relating to the provision of Services;
  2. Persons, entities or authorities who require the communication of your personal information as mandated by law or by order of the authorities;
  3. FOCSIV parent, subsidiary and affiliate companies, with the limitation to administrative-accounting purposes connected with the performance of organisational, administrative, financial and accounting activities;
  4. Credit institutes, insurance companies and brokers.

Furthermore, your personal data may be processed by subjects or categories of subjects acting as Data Processors pursuant to art. 28 of the GDPR, or who are authorised to process data pursuant to art. 29 of the GDPR.

Finally, FOCSIV reserves the right to publish images related to its events/activities or simply related to the usual activities carried out within FOCSIV premises and spaces, in order to give visibility to its activities, as well as for commercial purposes. Therefore, with your specific consent, your image, collected inside FOCSIV premises and/or spaces and/or on the occasion of your participation in FOCSIV events/activities, could be disseminated on the communication channels available to FOCSIV, such as by way of non-exhaustive example: electronic newsletter, FOCSIV official pages on social networks, the Controller’s website (http: //www.focsiv.it – hereinafter referret to as Website). Apart from the aforementioned, your data will not be disclosed except to subjects, bodies or authorities to whom the communication is mandatory under the provisions of law or of the GDPR.

Some of your personal data are shared with partners registered outside the European Economic Area. FOCSIV ensures that the processing of personal data by these takes place in compliance with the GDPR. Indeed, transfers can be based on a decision of adequacy or on the Standard Contractual Clauses approved by the European Commission. 

G) STORAGE OF PERSONAL DATA

Your personal data, including those falling under “special categories” of data, will be processed using automated tools, and will be kept for the time necessary to fulfil the objectives pursued. All the above is enforced without prejudice to the further conservation envisaged by the applicable legislation, including the provisions of art. 2946 of the Italian Civil Code.

H) RIGHTS BY THE DATA SUBJECTS (see arts. 15-22 of the GDPR).

You have the right to ask FOCSIV, at any time, access to your personal data, their correction or deletion or to oppose to their processing. You have the right to request the restriction of processing in the cases provided by art. 18 of the GDPR, as well as to receive the personal data concerning you in a structured, commonly used and machine-readable format, in the cases provided for by art. 20 of the GDPR.

You have the right to withdraw, at any time, the consent to the processing of your personal data for the purposes referred to in point E, 4th, 5th and 6th paragraphs. The possible revocation will not affect the lawfulness of the treatment based on the consent given before the revocation.
